Terms of Service
The terms, in plain words.
Who we are
Macroz is provided by Chance Marine, an individual developer based in Indiana, USA (“we” and “us”). These terms are an agreement between you and us. You can reach us at support@macroz.co.
What Macroz is
Macroz is a food and progress log for iPhone, with a website at macroz.co. It helps you write down what you eat, see how your days add up, and set a calorie and macro target. By creating an account, subscribing or using Macroz you agree to these terms, our Privacy Policy and our Consumer Health Data Privacy Policy. If you do not agree, do not use Macroz.
Who can use Macroz
You must be 18 or older and in the United States to use Macroz. You must be able to make a binding contract and must not be barred from using Macroz under US law, including US sanctions and export rules. Macroz is not for children.
Not medical advice
Nutrition figures, targets and check-in suggestions in Macroz are for tracking what you eat. They are not medical advice, diagnosis or treatment. Macroz is not a medical device and is not meant to diagnose, treat or manage any disease or condition. Talk to a clinician before changing how you eat if you have a health condition, take medicine affected by diet, are pregnant or breastfeeding, or have ever had an eating disorder, and follow their advice over anything the app says. If tracking food makes you anxious or unwell, stop and talk to a clinician or someone you trust. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline). In an emergency, call 911.
AI and accuracy
AI features are optional. When you turn on AI sharing, Macroz uses AI to read what you type, say or photograph, estimate foods, portions and nutrition, and answer questions. AI can be wrong, and so can nutrition databases and labels. Check what Macroz logs, and do not rely on it for allergens, ingredients or medical diets. You decide what you eat. The Privacy Policy explains what is sent when AI sharing is on.
Where the nutrition data comes from
Most nutrition figures are provided by the fatsecret Platform API (www.fatsecret.com). By using Macroz you agree to be bound by the fatsecret Platform API Terms of Use, which you can read at https://platform.fatsecret.com/terms. Barcode fallback records can come from Open Food Facts, whose database is available under the Open Database License and whose individual contents are available under the Database Contents License. In the app, Settings → Privacy → Third-party data credits Open Food Facts and links to its source data, which is kept separate and can be downloaded from the Open Food Facts source cache. Other figures are read from a brand’s own label or menu, are used only where we have the right to reuse them, and may be corrected over time. Labels change; check the packet when it matters.
Your account
You sign in with Apple. Keep your device and Apple ID secure; what is logged under your account is treated as yours, and you are responsible for activity on it. You can request account deletion from Settings. After Apple identity confirmation, an accepted request closes the account and stops new writes. Hosted-diary cleanup can remain pending; the app shows pending or completed status. Deleting your account does not cancel an Apple subscription. Separate retention for backups and required records is explained in the Privacy Policy.
Subscriptions
Macroz requires Macroz Pro, an auto-renewing subscription sold through the App Store and billed monthly or yearly. The App Store shows the price and length before you buy. There is no free trial. Payment is charged to your Apple account when you confirm the purchase. The subscription renews automatically for the same length unless you cancel at least 24 hours before the end of the current period, and your Apple account is charged for the renewal within the 24 hours before the period ends. If the price changes, Apple tells you first and, where required, asks you to agree. Cancel any time in your iPhone’s Settings → your name → Subscriptions, or with Manage Subscription in Macroz’s Settings; access continues to the end of the paid period. Apple handles billing, renewals and refunds under its own terms, so refund requests go to Apple at reportaproblem.apple.com; we cannot issue refunds ourselves. Deleting your account does not cancel the subscription.
Your content
What you put into Macroz stays yours: your log, messages, photos, recipes, feature requests and support tickets. You give us permission to store, copy, process, send and display it only as needed to run, secure and support Macroz and as described in the Privacy Policy. That includes showing a published feature request, with your first name, to other Macroz users, and showing a meal you share to people who have the link. This permission ends when the content is deleted, except for copies the Privacy Policy says we keep. You promise that you have the right to share what you submit and that it does not break the law or anyone’s rights. If you send us an idea or feedback, we may use it without owing you anything.
Sharing
A meal you share by link can be opened by anyone who has the link and the app until the link expires 30 days later, after which the stored copy is removed through cleanup. Share only what you are happy for them to see. Do not share links to content that is not yours to share.
Public feature requests
Submit only content you have the right to share. Requests are reviewed before publication. We have zero tolerance for objectionable content and abusive users: harassment, threats, hate, sexual content, private personal information, spam and illegal content are not allowed. Use the request menu to report content or block its author. We review reports promptly, normally within 24 hours, remove content that breaks these rules, and can restrict or end the access of accounts that post it.
Support
Contact support@macroz.co for help, including when you cannot access the app.
Support tickets are private between you and Macroz. Be accurate and civil; a ticket that is abusive or not about the app may be closed without a reply.
Fair use
Don’t use Macroz to break the law, to harm others, or to copy, scrape or resell the data it shows you. Don’t reverse engineer Macroz except where the law allows it, access it by automated means, overload it, or get around its security, allowances or limits; don’t use someone else’s account; and don’t use AI features to create unlawful or harmful content. Assistant, photo and search requests carry a monthly allowance so the service stays affordable for everyone; the app tells you when it is used up. We may suspend access that abuses the service or its providers.
Copyright complaints
If you believe something in Macroz infringes your copyright, email support@macroz.co with your contact details, the work you believe is infringed, where the material appears in Macroz, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you own the copyright or may act for its owner, and your physical or electronic signature. We remove infringing material and end the access of repeat infringers where appropriate.
Apple and the App Store
These terms are between you and us, not Apple, and Apple is not responsible for Macroz or its content. The app is licensed to you under Apple’s Licensed Application End User License Agreement for use on Apple devices you own or control, as the App Store’s Usage Rules allow; these terms cover the Macroz service. Apple has no duty to provide maintenance or support for Macroz. If Macroz fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the fullest extent the law allows, Apple has no other warranty obligation for Macroz. We, not Apple, are responsible for handling any claims about Macroz, including product liability, failure to meet a legal or regulatory requirement, consumer protection, privacy, and claims that Macroz infringes someone’s intellectual property. You confirm that you are not in a country subject to a US government embargo or designated by the US government as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Ending your use
You can stop using Macroz and delete your account at any time. We may suspend or end your access if you break these terms, if your use puts Macroz, its providers or other people at risk, or if we stop offering Macroz; where we can, we will tell you first. If we stop offering Macroz entirely, we will give reasonable notice. The sections on disclaimers, limits on liability, indemnity and disputes continue after your access ends.
Disclaimers
MACROZ IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT NUTRITION DATA, AI ANSWERS, ESTIMATES OR TARGETS ARE ACCURATE OR RIGHT FOR YOU, OR THAT MACROZ WILL ALWAYS BE AVAILABLE, SECURE OR FREE OF ERRORS. Some states do not allow these exclusions, so some of them may not apply to you.
Limits on liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATING TO MACROZ, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO MACROZ IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR MACROZ IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR $50. These limits do not apply where the law does not allow them, such as to liability for fraud, gross negligence or wilful misconduct, or for death or personal injury caused by our negligence.
Indemnity
If someone brings a claim against us because you broke these terms or the law, or because content you submitted infringed their rights, you agree to cover our reasonable costs and losses from that claim, including reasonable legal fees, to the extent the law allows. We will tell you about the claim and let you take part in the defense.
Disputes and arbitration
Indiana law governs these terms, without regard to conflict-of-law rules, except where the law of the state you live in must apply.
Talk to us first. Before starting a claim, email support@macroz.co with “Dispute” in the subject, your name, the problem and what you want. We will try to resolve it with you within 60 days.
Arbitration. If we cannot resolve it, you and we agree that any dispute arising from or relating to Macroz or these terms will be settled by final and binding individual arbitration, not in court. Either of us may still bring an individual claim in small claims court, and either of us may ask a court to stop misuse of intellectual property. The American Arbitration Association (adr.org) runs the arbitration under its Consumer Arbitration Rules, including its mass-arbitration rules where they apply. We pay the fees those rules assign to businesses. The arbitration can take place by video or phone, or in the county where you live. The Federal Arbitration Act governs this section. The arbitrator can award the same individual relief a court could, but only for you.
No class actions. You and we may bring claims only individually, not as a plaintiff or class member in a class, collective or representative proceeding. If a court decides this waiver cannot be enforced for a claim, that claim alone goes to court instead of arbitration. A claim for public injunctive relief that the law does not allow to be waived or arbitrated goes to court after any individual arbitration ends.
Opting out. You can opt out of arbitration by emailing support@macroz.co within 30 days after you first agree to these terms, with your name and a statement that you opt out of arbitration, from the email address linked to your account if you can. Opting out changes nothing else in these terms.
Courts. Any dispute that is not arbitrated goes to the state courts in Hamilton County, Indiana, or the federal court for the Southern District of Indiana, and you and we agree to those courts, except that you may bring an individual claim in small claims court where you live. If we change this section, the change will not apply to a dispute we already knew about, and you can reject the change by emailing us within 30 days.
General
These terms, with the Privacy Policy and the Consumer Health Data Privacy Policy, are the whole agreement between you and us about Macroz. If any part is found unenforceable, the rest stays in effect. If we do not enforce a part right away, we have not given it up. You may not transfer these terms. We may transfer them to whoever takes over Macroz, such as a company formed to run it, and we will tell you if we do. We are not responsible for delays or failures caused by events beyond our reasonable control. We may send notices in the app or to the email address linked to your account.
Changes
We may update these terms. Material changes are shown in the app before they take effect. Continuing to use Macroz after a change means you accept it. If you do not agree, stop using Macroz and cancel your subscription.
